Terms of Use
Effective: 26 August 2026
Important: FlightGuard is a supplementary organisational tool. It does not determine airworthiness, establish regulatory compliance or replace official aircraft records, approved maintenance data or qualified aviation personnel.
1. Scope and operator
These Terms govern your use of the FlightGuard mobile applications, the FlightGuard Web App and related services (together, the “Service”). The Service is operated by Isabelle Spandl, B.Sc., Rauhholzstraße 54c, 6971 Hard, Austria.
By creating an account or using the Service, you agree to these Terms. If you use FlightGuard for an organisation, partnership, club or another aircraft owner, you confirm that you are authorised to do so.
2. Eligibility and accounts
You must be at least 18 years old and legally able to enter into the relevant agreement. You must provide accurate account information, keep your credentials secure and promptly inform us if you suspect unauthorised access. You are responsible for activity carried out through your account unless mandatory law provides otherwise.
3. Supplementary aviation tool only
FlightGuard assists with organising aircraft maintenance and continuing-airworthiness information. It does not approve return to service, authorise dispatch, determine an aircraft's airworthiness or replace professional judgement.
You must verify all requirements, applicability decisions, intervals, tolerances, due values, source data and generated reports against current official authority publications, approved maintenance data, aircraft technical records and manufacturer instructions.
Responsibility remains with the aircraft owner or operator and the appropriately authorised aviation personnel and organisations. Maintain the official records and independent backups required for your operation. FlightGuard must not be used as the only copy of safety-critical or legally required records.
4. Automated, forecast and AI features
AD Smart Scan, keyword results, serial-number hints, applicability filtering, maintenance forecasts, trend analysis, status calculations, reminders, notifications, OCR and AI extraction may be incomplete, delayed or incorrect. They are review aids, not compliance decisions.
- Review every suggested AD and determine applicability using the official directive and approved aircraft data.
- Verify every predicted date, maintenance window, remaining value and report before relying on it.
- Check and correct AI-extracted logbook data before saving it.
- Do not treat a notification or the absence of a notification as proof that no action is required.
5. Your records and shared access
You retain responsibility for information, documents and images you enter or upload and confirm that you have the rights and permissions needed to process them.
Sharing an aircraft grants the selected user access to its records according to the assigned role. Other authorised users may create or modify records, and activity information may identify who made a change. Aircraft owners are responsible for managing access and resolving disagreements between shared users.
6. Licence to process your content
You retain ownership of content you submit. You grant FlightGuard the limited, non-exclusive licence needed to host, process, reproduce and transmit that content solely to operate, secure and support the Service and provide features you request. This licence ends when the content is deleted, subject to temporary backups, legal retention duties and content that remains in aircraft records owned by another user.
7. Subscriptions, trials and payments
Paid features are offered as FlightGuard Premium subscriptions. The price, billing period and any trial are shown before purchase. Store prices are displayed in the applicable local currency and include taxes where required by the store and applicable law.
- Purchase: Subscriptions may be purchased through the Apple App Store, Google Play or another checkout made available by FlightGuard.
- Renewal: A subscription may renew automatically unless cancelled before the store's stated renewal deadline.
- Cancellation: Manage or cancel the subscription through the account or store through which it was purchased. Cancellation stops future renewal and normally leaves access active until the end of the paid period.
- Refunds: Refunds are handled under the applicable store rules and mandatory consumer law.
- Cross-platform access: A recognised active entitlement can be used on supported devices, including the Web App, when you sign in with the same FlightGuard account.
Deleting your FlightGuard account does not automatically cancel a store subscription. Cancelling a subscription does not delete your FlightGuard account or aircraft records.
8. Acceptable use
You must not:
- use the Service unlawfully or in violation of aviation, privacy, intellectual-property or other applicable law;
- upload content you are not authorised to process;
- attempt unauthorised access, interfere with security or disrupt the Service;
- use automated means to scrape, overload or abuse the Service;
- reverse engineer the Service except where mandatory law expressly permits it; or
- misrepresent FlightGuard output as an official authority or maintenance approval.
9. FlightGuard intellectual property
The Service, branding, software, visual design and original content are owned by Isabelle Spandl or the relevant licensors and are protected by applicable intellectual-property law. These Terms give you a personal, limited, revocable, non-exclusive and non-transferable right to use the Service for its intended purpose while your account and applicable entitlement remain active.
10. Availability and changes
We may maintain, update, change or discontinue features and cannot promise continuous, secure or error-free availability. Cloud synchronization, external authority sources, store services and notifications can be delayed or unavailable. We will use reasonable care when making material changes and provide notice where required by law.
11. Suspension, termination and account deletion
You may stop using FlightGuard and delete your account from Profile. We may suspend or terminate access for serious or repeated violations, security risks, fraud, non-payment or legal requirements, with reasonable notice where practicable.
Account deletion removes the authentication account and records you own from the active Service, as further described in the Privacy Policy. Records owned by another user are not deleted merely because your shared access ends.
12. Third-party services and source material
FlightGuard relies on services provided by Google/Firebase, Apple, Google Play, RevenueCat, OpenAI and other providers described in the Privacy Policy. Their availability and independent terms may affect parts of the Service. Official aviation publications, manufacturer data and other third-party source material remain subject to their own terms and are not controlled by FlightGuard.
13. Warranty and liability
To the maximum extent permitted by law, FlightGuard is provided “as available” without guarantees beyond mandatory statutory rights. We do not warrant that records, calculations, forecasts, search results, AI output or notifications are complete or suitable for a particular aviation decision.
We are not liable for indirect or consequential loss caused by ordinary negligence. Nothing in these Terms excludes or limits liability where exclusion is prohibited, including liability for intentional or grossly negligent conduct, personal injury, product liability where applicable, or mandatory consumer warranty rights.
14. Governing law and consumer rights
Austrian law applies, excluding conflict-of-law rules, without depriving consumers of mandatory protections or courts available under the law of their habitual residence.
If FlightGuard is distributed by Apple, Apple's Standard EULA also applies to the extent it does not conflict with these Terms or mandatory law. Purchases through Google Play are additionally subject to the applicable Google Play terms.
Information about recognised consumer dispute-resolution bodies is available from the European Commission. FlightGuard is not willing or obliged to participate in dispute-resolution proceedings before a consumer arbitration body unless mandatory law requires otherwise.
15. Changes to these Terms
We may update these Terms to reflect product, provider, legal or operational changes. Material changes will be communicated in the app, on the website or by another appropriate method before they take effect where required. If a change requires your consent under applicable law, we will request it.
