Terms of Use

1. Introduction

Welcome to FlightGuard. By downloading, accessing, or using the FlightGuard mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

FlightGuard is operated by Isabelle Spandl, based in Austria.

2. Eligibility

You must be at least 18 years old to use FlightGuard. By using the App, you represent and warrant that you meet this age requirement.

3. Use of the App

FlightGuard is a tool designed to assist pilots and aircraft owners in tracking flight hours and maintenance status. You agree that:

You are responsible for the accuracy of the data you enter into the App.
You will not use the App for any unlawful purpose or in violation of any applicable regulations.
You will not attempt to reverse engineer, modify, or create derivative works of the App.

4. User Accounts and Shared Access

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

When using the aircraft sharing feature to grant access to co-owners or partners:

You are responsible for whom you invite to access your aircraft data.
All users with shared access can view and edit aircraft data.
You can revoke shared access at any time through the App.
FlightGuard is not liable for disputes between co-owners or partners regarding data accuracy, edits, or access.

5. Aviation Disclaimer

FlightGuard is an informational and organizational tool only.

FlightGuard does not replace:

Official aircraft technical logbooks
Approved maintenance programs (AMP)
CAMO or maintenance organization records
Airworthiness Review Certificates (ARC) or other official documentation
Pre-flight inspections or pilot-in-command responsibilities

You remain solely responsible for verifying aircraft airworthiness through official documentation before every flight. FlightGuard accepts no responsibility for flight safety decisions based on data displayed in the App.

Always consult your aircraft's official documentation and comply with the requirements of your aviation authority (e.g., EASA, FAA, or local CAA).

6. Subscriptions and Payments

FlightGuard offers a subscription-based service ("FlightGuard Pro").

Free Trial: We may offer a free trial period. You will not be charged if you cancel at least 24 hours before the trial ends.
Billing: Payments are processed through your Apple App Store account. Prices may vary by country and are displayed in your local currency.
Renewal: Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period.
Cancellation: You can cancel your subscription at any time via your Apple ID settings (Settings → Apple ID → Subscriptions). The cancellation will take effect at the end of the current billing period. No refunds will be provided for partial billing periods.

7. Intellectual Property

The App and its original content, features, and functionality are owned by FlightGuard (Isabelle Spandl) and are protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the App without prior written consent.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

FlightGuard is provided "as is" and "as available" without warranties of any kind, either express or implied.
FlightGuard shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the App.
We do not guarantee that the data calculated or displayed by the App (e.g., remaining flight hours, maintenance intervals) is always accurate, as calculations depend on the data you provide.
FlightGuard is not liable for any decisions made based on information displayed in the App, including but not limited to flight safety decisions.

In jurisdictions that do not allow the exclusion of certain warranties or limitations of liability, our liability shall be limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify and hold harmless FlightGuard (Isabelle Spandl) from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We reserve the right to suspend or terminate your access to FlightGuard at any time, without prior notice, for conduct that we believe:

Violates these Terms
Is harmful to other users or the App
Is fraudulent or illegal

Upon termination, your right to use the App will immediately cease. You may cancel your account at any time by discontinuing use of the App and canceling any active subscriptions.

11. Third-Party Services

FlightGuard uses third-party services to provide its functionality, including but not limited to:

Google Firebase (data storage and synchronization)
Apple App Store (payments and distribution)
RevenueCat (subscription management)

Your use of these services is subject to their respective terms and privacy policies. FlightGuard is not responsible for the practices of third-party services.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or for legal, regulatory, or operational reasons.

If we make material changes, we will notify you through the App or via email at least 14 days before the changes take effect. Your continued use of the App after the effective date constitutes acceptance of the updated Terms.

We encourage you to review these Terms periodically.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Austria, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Austria.

If you are a consumer residing in the European Union, you may also be entitled to use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FlightGuard regarding your use of the App and supersede any prior agreements.
